The terms of this agreement shall be as follows:
Toy Hauler Rentals agrees to rent the following trailer and included accessory equipment to the renter under the following conditions. 
1. Trailers will be inspected by the renter to acknowledge cleanliness, that all systems are operational, and sign an inventory listing all equipment included with the rental. Also noted will be the generator HOBBS METER at time out______________ PROPANE LEVEL FULL
2. Renter will be familiarized as to the operation of the assorted systems and will acknowledge this by signature.
3. Renter agrees to rent from Toy Hauler Rentals. These monies will be paid in advance of the rental. In the event the trailer is not returned on the agreed upon date and time, a revised daily rate of $300.00 shall be assessed until the trailer is returned.
***Pick-up time is 1:00 p.m. and must be returned by 10:00 a.m. A fee of $30.00/hr. is charged for trailers turned in late. ***
4. A Cleaning/Security deposit of $500.00 shall be deposited along with the total amount agreed on for the rental period. Trailer and equipment shall be returned in the same general state of cleanliness and repair, with holding tanks completely empty as when rented. Otherwise, the Cleaning/Security deposit will not be refunded. Cleaning/Security deposit will be returned within 5 business days.
5. Renter shall provide proof of insurance by current document from the insurance agency citing the specific VIN numbers, to include a Rider with Property, Liability, Damage, Uninsured Motorist, and Medical covering the Trailers. Damage caused by striking overhead objects, sideswiping, and undercarriage is considered negligence, misuse, or carelessness: the renter is 100% liable. A spare tire is provided. We do not take responsibility for flat tires. The renter is responsible for repairs. In the event of an accident, a police report must be filled/submitted and Toy Hauler Rentals must be contacted. 
6. Renter shall be held liable for any and all damages, including those that might exceed the Security/Cleaning deposit. NO SMOKING IN TRAILERS AT ANY TIME. Pets are allowed. An additional sanitation/cleaning fee will be charged if pets damage interior/exterior. (We check with black light). If seafood smell is strong, an additional cleaning fee will apply. A waste fee/propane fee of $85.00 in addition to rental price is charged to renter. If trailer batteries are drained below half, there is a $50.00 replacement cost to the renter. If it is necessary to have repairs done during your trip, receipts and old parts must be returned to us before reimbursement. Call us for approval on any repairs. Renter shall also be charged for time that a trailer is kept out for service at a rate of $100.00 per day if trailer is damaged and unable to rent during that new rental period.
7. Renter shall be limited to 4 hours of generator use per day under the terms of this agreement. Any time beyond the four hours times the number of days will be assessed at $5.00 per hour.
8. RENTER AGREES TO INDEMNIFY, DEFEND AND HOLD HARMLESS TOY HAULER RENTALS, OWNER’S AND THEIR RESPECTIVE REPRESENTATIVES AND AGENTS (COLLECTIVELY, THE INDEMNIFIED PARTIES) FROM ANY AND ALL LOSSES, LIABILITIES, DAMAGES, CLAIMS, ACTIONS, COST AND EXPENSES, INCLUDING WITHHOUT LIMITATIONS, COURT COSTS AND ATTORNEY FEES OF EVERY TYPE BROUGHT FOR OR ON THE ACCOUNT OF ANY ACTUAL OR ALLEGED PERSONAL INJURY, DEATH, PROPERTY LOSS OR ANY OTHER TYPE OF DAMAGE OR EXPENSE SUSTAINED OR CLAIMED TO HAVE BEEN SUSTAINED BY ANY PERSONS, CORPERATION OR LEGAL ENTITY, TO THE EXTENT THE SAME MAY HAVE BEEN CAUSED OR BE CLAIMED TO HAVE BEEN CAUSED IN ANY WAY ARISING OUT OF OR CONNECTED WITH THE PERFORMANCE OF THE SERVICE UNDER THIS RENTAL AGREEMENT.
9. A $250.00 deposit will be required to hold the trailer for a specific date. All reservation cancellations will be subject to a minimum charge of $50.00. If you cancel less than four weeks prior to your scheduled departure date you will forfeit both your deposit and confirmation payment ($250.00).
10. A $40.00 fee will apply for returned/cancelled/bounced checks. No refund is given for unused rental days under any circumstances. No fuel storage inside trailers at any time.
11. This trailer shall not be operated outside of the United States Of America.
12. THIS AGREEMENT SHALL BE COVERED BY THE LAWS OF THE STATE OF CALIFORNIA. IF ANY OF THE TERMS OR PROVISIONS OF THIS AGREEMENT SHALL BE DECLARED INVALID, ALL THE REMAINING TERMS AND PROVISIONS SHALL REMAIN IN FULL FORCE AND EFFECT.
13 The renter has notified their insurance agent of their intention to rent a trailer from TOY HAULER RENTALS. The renter has been advised by their agent that their liability and property damage insurance covers risk of loss to the trailer vehicle and their risk of liability for injury or damage to others or their property, and that the renter’s insurance policy has been endorsed accordingly.
